Legal Notice

RA Stefan Kirchner, MJI, is admitted to the bar in Germany (Rechtsanwalt). He is a member of the chamber of lawyers of Frankfurt (Rechtsanwaltskammer Frankfurt am Main). The Rechtsanwaltskammer Frankfurt am Main is the public body in charge of admitting attorneys and supervising them. The admission to the bar is based on the laws or the Federal Republic of Germany. Under German law, the duties of a lawyer are essentially determined by the Bundesrechtsanwaltsordnung, the Rechtsanwaltsvergütungsgesetz, the Berufsordnung für Rechtsanwälte, the Berufsregeln der Rechtsanwälte der Europäischen Union and the Fachanwaltsordnung. The aforementioned rules are published in the German Federal Gazette, the Bundesgesetzblatt and are available through the Rechtsanwaltskammer Frankfurt am Main and the Federal Chamber of Attorneys (Bundesrechtsanwaltskammer).

 

Rechtsanwalt Stefan Kirchner, MJI, has passed the theory course for specialised lawyers (Fachanwaltskurs - Theorie) for the area of administrative law, which includes immigration law. During his legal education his elective courses were International and European Law (in the 1st state examination in law) and Business Law, including Corporate Law (in the 2nd state examination in law). He has published widely in international law and has taught administrative, public and international law at universities in Germany and abroad.

Representation and Consultation

While the bulk of our immigration work is done at govenment offices of various levels of public administration as well as in courts for administrative law, we can represent you before all German courts, with the notable exception that the representation before the Supreme Court, the Bundesgerichtshof, is limited to cases of Criminal Law. In addition we represent you before the European Court of Human Rights and other international and European bodies, including the European Court of Justice, the European Court of First Instance, International Criminal Court, the International Criminal Tribunal for the formery Yugoslavia, the Human Rights Committe under the International Covenant on Civil and Political Rights. In addition we represent you in cases of international arbitration. If you want to request Rechtsanwalt Kirchner to serve as an abitrator, please contact our Antrifttal office for further information. Note that for legal reasons we are at this time unable to offer mediation services. Furthermore we ask your kind understanding that we have to refrain from representing you before the Iran Tribunal for as long as Mr Kirchner is a member of the same body in order to avoid conflicts of interests. Standard languages in the firm are German and English. In case translators are needed for other languages, the costs of our services can increase accordingly.

Appointments, Client-Attorney-Contract, Costs

Meetings are strictly only with an appointment. The use of this website does not establish a contract between the user and the law firm. A client-attorney-contract needs to be in writing between Rechtsanwalt Kirchner and the client in question. Due to frequent appointments etc., we prefer to communicate via email. By communicating via email, you agree that you are aware of the dangers of using email, in particular the danger that third parties might gain illegal access to the communication without the consent or knowledge of the parties involved in the communication, as is the case in a similar manner with other means of communication. For video conferences etc. please contact the firm in advance.

The costs for our services are based on the German Rechtsanwaltsvergütungsgesetz (RVG) and / or a separate agreement concerning the costs of legal services which is to be concluded between the client and the attorney. Regarding the details of a cost agreement, contact the firm via email at mail(at)rechtsanwaltskanzlei-kirchner(dot)de.

Should you not be able to pay the attorney’s fees as set down in the RVG, you might be entitled to legal aid, Prozesskostenhilfe (PKH). The German Federal Ministry of Justice can make more detailed information available on this issue and the court which is in charge of your case can give you a form with which to apply for PKH.
